Oklahoma's tax picture has changed: the franchise tax has ended, the state no longer collects its sales tax on groceries, and the PTE election can now be made on a timely filed return. If you live, work, own property or run a business here, or sell into the state, this page covers tax year 2025 returns and 2026 planning. It is general information, not personal advice.
Income tax: a top rate reached quickly
For 2025 Oklahoma taxes income at 0.25% on the first $1,000 for a single filer and steps up through 0.75%, 1.75%, 2.75% and 3.75% to a top rate of 4.75% above $7,200. Joint filers and heads of household reach the same top rate above $14,400. The Oklahoma Tax Commission (OTC) rates page shows 2025 and earlier years only, so check it for 2026.
The 2025 standard deduction is $6,350 for single or married filing separately, $9,350 for head of household and $12,700 for joint filers, plus $1,000 per exemption. Subtractions that matter for retirees include:
- Social Security benefits included in federal adjusted gross income.
- 100% of military retirement benefits from any component of the armed forces.
- Up to $10,000 of qualifying government or other retirement income.
Part-year residents and nonresidents file Form 511-NR once Oklahoma-source income reaches $1,000. A resident is anyone domiciled in the state, and domicile continues until a new one is established, so keeping an Oklahoma driver's license or homestead exemption can matter after a move.
Tribal members and Indian country
Oklahoma has an unusual deduction: an enrolled tribal member whose principal residence is in Indian country within their own tribe's jurisdiction may deduct income earned there, using Schedule 511-A. The 2025 packet requires a membership card, trust or restricted-land documents for the home and workplace, and employment records. This covers income tax only; other taxes have their own rules.
Business taxes, the ended franchise tax and the PTE election
Oklahoma's corporate income tax is 4%. The franchise tax ended with tax year 2023 as the last required return, although foreign corporations still pay a registered agent fee on Form 200-R.
Pass-through entities may elect entity-level tax under the Pass-Through Entity Tax Equity Act. The election is made on Form 586 or in OkTAP, the OTC's online system, and beginning with tax year 2024 it may be made with the timely filed return, extensions included. Without an election, a pass-through entity must withhold on distributions to individual nonresident members unless it has received a completed Form OW-15. Owners should weigh it against the federal SALT deduction cap.
At the Secretary of State, articles of organization cost $100 and the LLC annual certificate $25. The certificate is due each year on the formation date, with a 60-day grace period before the entity becomes inactive.
Sales tax, food and local rates
The state rate is currently 4.5%, and cities and counties add their own, so rates differ between Oklahoma City, Tulsa and smaller towns. Since August 29, 2024 the state portion on food and food ingredients is 0%, while certain prepared food, alcoholic beverages and dietary supplements remain at 4.5% and local tax still applies to groceries. Returns are generally due on the 20th of the following month; vendors remitting $50 a month or less may file semi-annually.
Remote sellers must register and collect when Oklahoma taxable sales exceed $100,000 in the preceding or current calendar year (sales tax nexus). Public charging stations owe a separate DRIVE Act tax of $0.03 per kilowatt-hour. See our sales and use tax service.
Payroll in Oklahoma
Withholding is filed through OkTAP, with frequency based on the amount withheld. A 2025 law requires withholding at the highest rate on payments to loan-out companies for Oklahoma services (Form OW-21 starts with tax year 2025), which can matter for film and media productions.
Employers must report new hires within 20 days of the start date to the Oklahoma Employment Security Commission (OESC), which also handles unemployment insurance. A business generally owes unemployment tax once it pays $1,500 or more in a quarter. New employers are assigned a 1.5% rate, and OESC lists a $24,400 taxable wage base for 2027, so check its charts for 2026. See new hire reporting and state unemployment insurance. Confirm workers' compensation rules with the Oklahoma Workers' Compensation Commission. For states that add city or county payroll levies, see local payroll taxes.
Oil and gas, property tax and education credits
Oil and natural gas gross production tax is reported by production unit number, usually through the first purchaser, on a monthly Form 341. Property is taxed ad valorem, and the OTC highlights a five-year exemption for manufacturing and research facilities (Form 900-XM), a storm shelter exemption and an exemption for 100% disabled veterans. A refundable Parental Choice Tax Credit of $5,000 to $7,500 is available for eligible private school expenses.
