Many owners keep a short yearly routine for Illinois income tax. The Grand Prairie Filing Loop below is one general version, built from Illinois Department of Revenue (IDOR) material. It is not advice for any one business. The overview and rules and numbers pages explain the details behind each step.

The Grand Prairie Filing Loop

  1. Register with IDOR (Form REG-1 in MyTax Illinois) before hiring or collecting tax.
  2. Match the entity to its return: IL-1040, IL-1120, IL-1120-ST, IL-1065 or IL-1041.
  3. Check estimated tax before each installment date, and recalculate after a mid-year law change.
  4. Withhold 4.95% from pay, deposit it monthly or semiweekly, and file Form IL-941 each quarter electronically.
  5. For a pass-through entity, decide between the PTE election and pass-through withholding, and collect Form IL-1000-E from nonresident owners that are not individuals.
  6. Pay any tax due by the original due date, even if a filing extension is used.
  7. Open every IDOR notice on arrival and note any 60-day protest window it states.

Common mistakes

  • Treating the automatic extension as time to pay. Tax is due on the original date, or interest and penalty run.
  • Filing a second return with amended numbers instead of Form IL-1120-X, IL-1065-X or IL-1120-ST-X.
  • Filing the amended return before the IRS has finalized the federal change, or missing the 120-day deadline to report it.
  • Photocopying or whiting out a prior Form IL-941. The scanline decides the period and the federal employer ID number.
  • Assuming Form IL-1000-E still shields a nonresident owner after the entity elected PTE tax. IDOR ignores it then.
  • Skipping registration before hiring or collecting tax.
  • Ignoring a notice. When a notice states protest rights, the 60-day deadline is strict.

When to talk to an attorney

A CPA cannot answer legal questions like these. They call for an attorney:

  • A Notice of Deficiency, Notice of Tax Liability or personal-liability notice you want to contest, including Tribunal or circuit court petitions.
  • A criminal investigation, fraud-penalty exposure or a voluntary-disclosure decision.
  • Entity formation, buy-sell or operating-agreement questions behind a PTE or S corporation election.
  • A multi-state dispute where P.L. 86-272 protection is unclear.

Frequently asked questions

Does Illinois have a progressive income tax?

No. IDOR describes Illinois income tax as a flat rate. Individuals, trusts and estates pay 4.95% of net income, with no brackets. C corporations pay 7%.

Do S corporations and partnerships pay Illinois tax?

They pay 1.5% replacement tax at the entity level. They pay no regular income tax at that level unless they elect PTE tax, and their owners pay income tax on their shares.

Does an extension give more time to pay?

No. Illinois extends the filing date automatically for several returns, but the tax is still due by the original due date. Late payment penalties and interest run from that date.

Do remote employees trigger Illinois withholding from day one?

Not necessarily. For a nonresident employee, IDOR does not require withholding if the person works fewer than 31 days in Illinois and the pay is not localized here. Employers also need not withhold for residents of Iowa, Kentucky, Michigan and Wisconsin, under reciprocal agreements.

A CPA can help with the payroll, tax and accounting side of these rules and works alongside the owner's attorney. See also the Illinois Wage Payment and Collection Act, our Illinois state guide and our guide to state tax notices.
